or &#8220;estate&#8221;).\nSuch an inheritance can be received as a legal heir or as an heir named in a will.\nLegal heirs are, for example, the children or spouse of the deceased.\nDesignated heirs are determined by the testator in the <a href=\"https:\/\/app.testamentservice.at\/testament\">will<\/a> or in an inheritance contract.\nAll heirs become members of the community of heirs and thereby acquire rights and obligations.\nAs an heir, you are entitled to a certain share of the estate, depending on how many other heirs you have to share with.\nHowever, you also always assume the debts of the deceased.      <\/p>\n\n\n\n<p>Example 1:<br\/><em>Theodor is single and has no children.\nHe also has a niece, but has little contact with her.\nTheodor has supported animal welfare all his life and feels a close bond with animals.\nIf Theodor did not make any arrangements, his niece would be the only remaining legal heir to his estate.\nTheodor therefore decides to settle his estate and leave his assets, including an apartment building in Vienna, to the animal welfare organization of his choice in a will.\nHe also made the inheritance subject to the condition that the association should ensure that his cat was always well looked after until his death.     <\/em><\/p>\n<\/div>\n<\/div>\n\n\n\n<div id=\"beguenstigungen\" class=\"wp-block-group is-nowrap is-layout-flex wp-container-core-group-is-layout-d90c9cc4 wp-block-group-is-layout-flex\" style=\"margin-bottom:var(--wp--preset--spacing--70)\">\n<figure class=\"wp-block-image size-full is-resized bg-da-default p-4 rounded-full\"><img decoding=\"async\" src=\"https:\/\/www.deinadieu.at\/wp-content\/uploads\/2023\/05\/legat.svg\" alt=\"\" class=\"wp-image-61303\" style=\"width:25px;height:25px\"\/><\/figure>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\n<h2 class=\"wp-block-heading\" id=\"h-legat-vermachtnis\"><strong>Legacy<\/strong><\/h2>\n\n\n\n<p>In the case of a legacy, the legatee does not become part of the community of heirs.\nThe legatee is entitled to a specific item (e.g. a painting) or a specific amount of the estate (e.g. EUR 10,000) from the estate or later from the community of heirs or individual heirs.\nA legatee is not subrogated to the debts of the testator.  <\/p>\n\n\n\n<p>Example 2:<br\/><em>Anton has a daughter and a wife.\nAs he has supported a children&#8217;s charity (non-profit organization) all his life and children are very close to his heart, he would like to take this into account.\nHe asks lawyer Mag. (will).\nIn the past, the ABGB also used the term &#8220;codicil&#8221;, which stood for a unilateral testamentary disposition that could be revoked at any time and, unlike a will, did not include the appointment of an heir but merely other dispositions. <\/p><\/div><\/div>\n\n\n\n<div class=\"wp-block-create-block-deinadieu-faq-item\"><div class=\"inner\"><p class=\"title\" style=\"color:\"><span>What is the difference between heirs and legatees (in the case of an inheritance or legacy)?<\/span><i><\/i><\/p><p class=\"text\" style=\"color:\">The heir becomes a member of the community of heirs.\nThe <strong>legatee is not a member of the community of heirs<\/strong>, but merely has a claim for restitution against the community of heirs.\nThe heirs, on the other hand, acquire a variety of rights and obligations.\nIn particular, they also assume the debts of the testator.   <\/p><\/div><\/div>\n\n\n\n<div class=\"wp-block-create-block-deinadieu-faq-item\"><div class=\"inner\"><p class=\"title\" style=\"color:\"><span>What part of the inheritance can I freely dispose of?<\/span><i><\/i><\/p><p class=\"text\" style=\"color:\">The <strong>freely disposable portion is determined by deducting all compulsory portion claims from the estate<\/strong>. These vary depending on <strong>which heirs are present<\/strong>. If, for example, there is a spouse (statutory inheritance share 1\/3, compulsory portion 1\/6) and a child (statutory inheritance share 2\/3, compulsory portion 1\/3), the disposable share is (1 &#8211; 1\/6 &#8211; 1\/3 = 1\/2). The testator can do what he or she wants with this half.
